The following terms of Terms of Use govern your access to and use of:

· our website

· our telematics solution platform (including APIs)

· any mobile device software provided by us

· any text, pictures, media, data, information and other materials or content provided by us

1. By using the FleetConnect solution, you represent and warrant that you have the capacity to enter into binding obligation, and comply with these Terms of Use.

2. If you are using the FleetConnect solution on behalf of another person or a corporate entity, you represent and warrant that you have the authority to bind such person or entity to these Terms of Use.

3. You confirm that you are authorized by the registered owner(s) of the vehicle in which the telematics device will be installed to install this device, allow information to be collected by the device, and permit us to retain and use the information according our contract. You also agree to inform others who operate your vehicle that it includes a telematics device that is gathering vehicle-usage data.

4. The telematics device logs location, vehicle trip and engine data to provide a detailed history of trips parameters, driver behaviour and vehicle performance. The device may collect information that includes, but is not limited to:

· acceleration,

· deceleration,

· time,

· speed,

· G-forces,

· distance,

· fuel,

· VIN,

· GPS,

· odometer,

· temperature,

· diagnostic codes.

This data will be collected from your vehicle and sent via wireless transmission to a secure data collection site.

5. FleetConnect has a privacy policy to protect your personal information. The privacy policy contains a detailed description of your rights and our practices and is available at https://www.fleetconnect.pl.

6. The FleetConnect platform service for Clients/Users are granted a non-exclusive and non-transferable right to use the service.

Clients are responsible for:

- equipping the vehicle with properly working telematics device

- use properly functioning browser software and internet access

- use computers, laptops or mobile devices sufficient capacity with the correct configuration

7. FleetConnect does neither warrant that GPS or the GSM will continue to support the functionality offered by FleetConnect

8. FleetConnect reserves the right to change the appearance and presentation of data and information, consistent with the terms of cooperation.

9. FleetConnect systems (software and hardware equipment) were designed to facilitate the organization and manage of: fleet, people, assets, workflow processes.

10. Under no circumstances FleetConnect guarantees or cannot guarantee, that the software and hardware will work without errors; therefore, FleetConnect will not be responsible for damages or losses of any kind, caused by the use or misuse of the system:

· lack of / errors / loss of information,

· lack of or failures in the notifications

11. The responsibility FleetConnect is limited, to the replacement of telematics device, within the conditions of limited warranty.

Hardware are guaranteed, against any proven defect and its proper functioning, for a period of 12 months from the date of installation of these. It does not include the transfer of technical staff in the case that the repair is not made in FleetConnect branches.

This guarantee is not valid for:

· Inadequate treatment of equipment in storage or use.

· When corrective maintenance is carried out by staff non-related to our company.

· Natural wear of parts and / or sets.

· Inappropriate use or vandalism.
